Renter Rights Bill - A quick overview

At R&G, we're all about speed, so here is a quick overview of the proposed renter's rights bill.



It is worth noting that this bill must still go through the house of commons & house of lords and then to royal assent before these changes are placed into effect and has a proposed date of Summer 2025.


1. Abolition of Assured Shorthold Tenancies
  • Current Legislation: Allows fixed-term assured shorthold tenancies, often used for six or 12 months.
  • Bill Proposal: Abolishes assured shorthold tenancies; all tenancies will be periodic with rent periods not exceeding one month.

2. New Grounds for Possession
  • Current Legislation: Specific grounds allow landlords to regain possession, including Section 21 ("no-fault" evictions).
  • Bill Proposal: Ends "no-fault" evictions; revises grounds, focusing on anti-social behaviour and rent arrears with stricter requirements.

3. Rent Increases
  • Current Legislation: Rent can be increased at the end of a fixed term or with tenant agreement.
  • Bill Proposal: Introduces statutory procedures for rent increases, allowing tenants to challenge excessive rent hikes.

4. Right to Keep Pets
  • Current Legislation: No statutory right to keep pets; landlords can refuse permission.
  • Bill Proposal: Tenants can request permission to keep pets, and landlords cannot unreasonably refuse.

5. Discrimination in the Rental Market
  • Current Legislation: Some discrimination, like refusing tenants on benefits or with children, is not explicitly prohibited.
  • Bill Proposal: Explicitly prohibits discrimination against families with children or those receiving benefits, enforcing financial penalties for violations.

6. Duties of Landlords
  • Current Legislation: Basic obligations include maintaining property standards and deposit protection.
  • Bill Proposal: Expands landlord duties, including providing clear tenancy terms and compliance statements.

7. Financial Penalties for Non-Compliance
  • Current Legislation: Limited enforcement measures for landlord misconduct.
  • Bill Proposal: Introduces financial penalties and offences for failure to comply with tenant protections, such as unlawful evictions or harassment.

8. Landlord Redress Schemes
  • Current Legislation: Some voluntary schemes exist but are not mandatory.
  • Bill Proposal: Mandates participation in landlord redress schemes, ensuring landlords are accountable.

9. Enforcement Powers
  • Current Legislation: Local authorities have limited powers to enforce housing standards.
  • Bill Proposal: Enhances enforcement powers, including investigatory powers for local authorities to ensure compliance.

10. Decent Homes Standard
  • Current Legislation: No universal standard applied across private rentals.
  • Bill Proposal: Sets a Decent Homes Standard for all rented properties, ensuring safe and healthy living conditions.

This bill aims to modernise rental laws, increase tenant protections, and promote fairer practices in the rental market, significantly altering the relationship between landlords and tenants compared to current legislation.
